should verify this as part of contracting and site induction.
2.10. Counter-Terrorism and Security Act 2015
This Act includes provisions to enhance the protection of critical infrastructure, which may include certain
construction projects considered critical, and places a duty on specified authorities to have due regard to
the need to prevent people being drawn into terrorism (the Prevent duty). Larger or higher-profile projects
should consider whether NPSA guidance on protecting crowded places or critical infrastructure
construction is relevant to their threat picture.
2.11. Building Act 1984
The Building Act 1984 and its associated regulations provide the legal framework for building control in
England and Wales. While primarily concerned with structural safety and integrity, building control
measures can indirectly support site security, for example through requirements affecting the physical
robustness of the completed structure.
2.12. Fire Safety (England) Regulations 2022
These regulations place responsibilities on employers and others with control of premises, including
construction sites, to take general fire precautions. CDM duty holders must co-ordinate and co-operate
with the responsible person(s) for fire safety while construction work is taking place. In practice, fire risk
assessment and site security assessment increasingly overlap, and current commercial guidance (see
Annex A) reports that insurers and contractors are bundling fire safety provision into the wider site
security risk assessment rather than treating the two as separate exercises.
2.13. Suitably Qualified and Experienced People (SQEP)
CDM section 15(7) provides that a contractor must not employ or appoint a person to work on a
construction site unless that person has, or is in the process of obtaining, the necessary skills, knowledge,
training, and experience to carry out the tasks allocated to them. This requirement applies as much to
those protecting the site as to those building it, and is a further reason why SIA licensing, relevant vetting
(see Section 6.3), and role-specific training matter.
